Necessary Judicial Transformation

The transformation of South Africa’s Judiciary is constitutionally prescribed, necessary and inevitable. However, its importance lies is the form it takes. The structure of South African courts and composition of the Judiciary still reflect the country’s apartheid history. Therefore, the question is not whether transformation should occur, but what steps should be taken to ensure that the process of transformation is effective, transparent and respects the independence of the Judiciary.
